BIG PHARMA AND THE TRANS PACIFIC PARTNERSHIP
Lawrenceville, NJ (Dr Simone) – The Trans Pacific Partnership is a massive trade deal soon to be completed. The text of the international trade deal is a closely held secret. Members of the US Congress can read it only if they agree to leave all recording devices, pens and their staffers out of the room. The information that has been leaked indicates a negative impact for our health and a huge cost increase for medicines. For example patents increase the cost of treating AIDS patients from $100 to $10,000.
The negotiations for this trade deal are being conducted by 12 Pacific Rim countries: Australia, Brunei, Canada, Chile, Japan, Malaysia, Vietnam, Mexico, New Zealand, Peru, Singapore, and the United States. India is not permitted in the negotiations but India’s patent laws are specifically targeted word for word because India allows patents on new drugs but not on new uses of old drugs or not on new forms of drugs that do not increase efficacy. The new treaty will outlaw this. This is important because many other countries are adopting India’s laws regarding Big Pharma patents.

This provision prevents the US FDA from registering a generic version of a drug for a certain number of years thereby keeping the price high for expired patented drugs.
“procedural obligations – the annex”
The agreement specifically says that United States Centers for Medicare and Medicaid Services (CMS) must comply. This will interfere with CMS decisions, and also make health programs in all countries vulnerable to Big Pharma.
“investor-state dispute settlement”
This permits Big Pharma companies to sue countries for hundreds of millions of dollars in damages for expected future profits that have been undermined by the member country. These lawsuits would be heard by individual private lawyers (“arbiters”), many of whom are influenced by big Pharma, without any chance of independent review by national or international court.
The US Congress has been asked to fast track this agreement – which means a simple majority will carry it. Increase in generic drug prices – smaller generic drug production
companies are either being bought out by big
drug companies, who in turn are raising prices, or they are purposely not
passing strict federal regulations, which cuts back on supply.
