BIG PHARMA PRICE-FIXING CONSPIRACY
Lawrenceville, NJ (Dr Charles Simone) – On May 10, 2019 43 states sue 20 Big Pharma companies, 11 of which are in New Jersey, for price-fixing conspiracy accounting for billions of dollars profit in the United States. Filed by Connecticut Attorney General William Tong stating: “We have hard evidence that shows the generic drug industry perpetrated a multibillion dollar fraud on the American people. We have emails, text messages, telephone records and former company insiders that we believe will prove a multi-year conspiracy to fix prices and divide market share for huge numbers of generic drugs.”
The lawsuit alleges:
Knowing their actions were illegal, corporate conspirators spoke to each other in person or by cell phone, to avoid a written paper trail using terms like “playing nice in the sandbox” and “responsible competitor” to describe their anti-competitive efforts.
For years these Big Pharma companies agreed not to compete with each other and settled for a “fair share… but also to “significantly raise prices on as many drugs as possible,” some by as much as 1000%.
Teva Pharmaceuticals USA Inc., a wholly owned subsidiary of Israeli-based Teva Pharmaceuticals Industries Ltd and its co-conspirators “embarked on one of the most egregious and damaging price-fixing conspiracies in the history of the United States.”
Teva increased prices on 112 different generic drugs and on 86 of those drugs colluded with a group it referred to as “high quality” competitors. Teva decided to lead and follow price increases of some Big Pharma companies that it already had “very profitable collusive relationships.”
